Backyard Fire Pit

Do I need a permit to have a fire pit?

The Town of Legal does not require residents to obtain fire permits to enjoy a backyard fire or barbeque. However, residents must apply for a Fire Pit Inspection to ensure their fire pit is permitted as described in the Town's Fire Bylaw #05-2022 prior to installing an acceptable fire pit. The fire pit inspection is free of charge.

Fire Pit Inspection Application Form

Once the Fire Pit Inspection Application form has been completed, please return to the Town Office. A member of the Fire Department will conduct the fire pit inspection.

Below are some useful guidelines to follow if you choose to have a Fire Pit in the Town of Legal.

  • must be a minimum of 4 meters (13.1 feet) from any part of a residence including any overhang.
  • must be a minimum of three meters (9.84 feet) from any property line, out buildings, overhead power lines, or combustible materials such as fences, trees, etc.
  • Ensure the Fire Pit is not located directly under any tree or overhanging branches
  • The opening cannot be no greater than 1 meter (39.4 inches) in width as measured across its widest part.
  • Have a depth of no more than 0.6 meters (23.6 inches).
  • In operation, use a spark arrester screen on it with maximum opening of 1.27 cm (1/2 inch).
  • Flames from the fire are not to exceed 0.9 metre in height at any time;
  • Do not leave the fire unsupervised at any time
  • Extinguish the fire completely, leaving only cold ashes, prior to leaving the fire
